Avid Art Works respects the intellectual property rights of others. All of my art works are original creations. Regarding the other content hosted on my site, the vast majority of this content content are original creations, or recorded music that I have the rights to as a creator, or contributor. However, there may be times when I might be hosting content created by others.
All images, graphics, video clips and music used within my created content are readily available in various places on the Internet and believed to be in public domain, or content that I have obtained licensing to use. Such elements used within my created content are utilized within my rights as outlined within the Fair Use Doctrine of U.S. Copyright Law (title 17, U.S. Code, Section 107).
Fair use is any copying of copyrighted material, or utilization of such material, done for a limited and “transformative” purpose, such as to use for educational or entertainment purposes, comment upon, criticize, report on, or parody such copyrighted work. Such uses can be done without permission from the copyright owner, or formal licensing.
When necessary and appropriate I will respond to notices of alleged copyright infringement as submitted via my web form below.
Avid Art Works also expects my viewers, users and contributors to respect the intellectual property rights of others, and in keeping with the Digital Millennium Copyright Act (DMCA) regarding such user-posted content. When necessary and appropriate, I will respond to notices of alleged copyright infringement as submitted via our web form below. And in keeping with my Terms of Use, and the intended use my Service, I reserve the right to remove any user-posted material that we deem in violation of anyone’s intellectual property rights and, or, copyrights.
To file a notice of infringement with me, you must download, complete and submit the form seen below to me via email at copyrights@avidartworks.com. Regarding your submission, if you do not hear a response from me within 10 days of submitting your notice of infringement, please email me again at contact@avidartworks.com or click on the "Submit a Question" link in the footer of the page below to confirm that I received your original submission, or that it didn't end up in my spam folder.
Please understand that simply being confused or angry about any particular usage of copyrighted material within my content is not enough to constitute copyright infringement. Be sure that you understand the law and my usage of the work(s) of alleged infringement. You will be liable for any damages (including courts costs and attorneys’ fees) if you incorrectly represent, or materially misrepresent, that any material on my site is infringing upon a copyright, or any intellectual right. I also reserve the right to publish your copyright infringement submission form on my website as a public notice.
